1About med96.in

The domain www.med96.in and associated mobile application (collectively, the "Platform") are operated by Med96 Healthcare Private Limited ("med96", "we", "us", "our"), a company incorporated under the Companies Act, 2013.

The Platform facilitates: (i) purchase of pharmaceutical products from third-party pharmacies; (ii) diagnostic testing services from third-party laboratories; (iii) online doctor consultation services; and (iv) general health information services.

2Eligibility to Use the Platform

Use of the Platform is subject to the following eligibility conditions:

✅ Who May Use

You must be 18 years or older and competent to contract under the Indian Contract Act, 1872. Parents or legal guardians may use the Platform on behalf of minors.

🚫 Who May Not Use

Minors (below 18 years) acting independently, persons of unsound mind, undischarged insolvents, and organisations or companies (who must not register as individual users).

By registering or using the Platform, you represent that you meet these eligibility criteria and that all information provided is accurate, current, and complete.

3Pharmaceutical Goods & Services

med96.in acts solely as an intermediary platform connecting you with third-party pharmacies ("Third-Party Pharmacies"). We do not hold title to or inventory of any pharmaceutical products.

All commercial transactions, including pricing, delivery, and warranties, are strictly between you and the Third-Party Pharmacy. med96.in is not a party to that contract.

The listing of medicines on the Platform constitutes an "invitation to offer" and not an offer for sale. Your order constitutes an offer, which is accepted only by the relevant Third-Party Pharmacy upon stock verification and prescription validation.

med96.in makes no warranty as to the authenticity, quality, or fitness of pharmaceutical products supplied by Third-Party Pharmacies.

4Prescription Drugs

For medicines requiring a valid prescription under the Drugs and Cosmetics Act, 1940 and Drugs and Cosmetics Rules, 1945 ("Prescription Drugs"), the following conditions apply:

med96.in will maintain records of uploaded prescriptions in compliance with applicable law.

5Diagnostic Services

med96.in facilitates access to diagnostic services offered by third-party laboratories ("Third-Party Labs"). med96.in does not conduct tests or generate reports itself.

med96.in does not verify, endorse, or guarantee the correctness of diagnostic reports issued by Third-Party Labs.
6Online Doctor Consultation Services

Medical Experts available on the Platform are independent contractors and not employees or agents of med96.in. Use of consultation services is subject to the following important conditions:

⚠️ No Doctor–Patient Relationship: Consultation on this Platform does not create a formal doctor–patient relationship. Information provided should not replace face-to-face consultation with a qualified physician.

med96.in will not be liable for any advice, diagnosis, or prescription issued by Medical Experts through the Platform.

7Personal Data & the DPDP Act, 2023

The collection, use, storage, and processing of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

In accordance with the Digital Personal Data Protection Act, 2023, you acknowledge:

By registering on med96.in, you explicitly consent to the collection and processing of your personal data — including health data — as described in our Privacy Policy, in compliance with the DPDP Act, 2023.
8Payment, Fees & Taxes

Registration and browsing on med96.in is free. Payments for products and services are made directly to Third-Party Pharmacies or Third-Party Labs as applicable.

All prices are exclusive of applicable taxes unless stated otherwise. Each user is solely responsible for taxes arising from their transactions. med96.in is not liable for payment failures or losses arising from third-party payment processors.

9Returns, Refunds & Cancellations

Returns and refunds on products and services are governed by our Return & Refund Policy, which forms an integral part of these Terms. Please review the Return & Refund Policy on the Platform before placing an order.

Cancellations may be subject to conditions based on order status, product type (e.g., Prescription Drugs), and service category (e.g., diagnostic tests). med96.in reserves the right to cancel orders that cannot be fulfilled by the relevant Third-Party Service Provider.

10Prohibited Conduct

Users and all parties accessing the Platform shall not:

Violations may result in immediate suspension of your account, legal action, and reporting to relevant authorities.

11Limitation of Liability & Indemnity

The Platform and all services are provided on an "as is, as available" basis without warranties of any kind. To the maximum extent permitted by applicable law:

Indemnity: You agree to indemnify and hold harmless med96.in, its officers, directors, and employees from any claims, losses, or damages arising from your violation of these Terms, applicable law, or the rights of any third party.

12Account Termination

You may close your account at any time through the Platform. Note that account deletion is permanent and irreversible — all order history and health records will be deleted.

med96.in reserves the right to suspend or terminate your account (with or without notice) if:

Upon termination, your data will be handled in accordance with our Privacy Policy and applicable data retention laws.

13Governing Law & Dispute Resolution

These Terms are governed by the laws of India, without reference to conflict of laws principles. The courts at New Delhi shall have exclusive jurisdiction over any disputes arising from these Terms.

Any unresolved disputes shall be referred to binding arbitration in New Delhi, in the English language, before a sole arbitrator appointed by med96.in under the Arbitration and Conciliation Act, 1996.

For data protection grievances, you may also approach the Data Protection Board of India if your complaint is not resolved within 30 days.

We will acknowledge your complaint within 48 hours and resolve it within 30 days. For escalations, contact the Data Protection Board of India.

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or Platform notice at least 7 days in advance. Continued use after the effective date constitutes acceptance.
